Manifestation Meeting

Through their Individual Education Plan (IEP), a student may have an adjusted plan for behavior and discipline. It is required by law that any student with an IEP (504 Plan) must have a manifestation meeting at his/her home school before being referred to Student Services due to behavioral incidents.

At the manifestation meeting, the team examines the impact that the student’s disability may or may not have had on an offending incident. If the student’s actions are determined to be a manifestation of his/her disability, then the maximum disciplinary action taken is a five- day suspension.

Nebraska State Statute 790265.01 (LB705) states that suspension is prohibited for students pre-kindergarten through second grade, with limited exceptions.

The Individuals with Disabilities Education Act (IDEA) requires schools to make necessary accommodations for students with disabilities to ensure they are provided a Free Appropriate Public Education (FAPE).
